This document is published in accordance with the provisions of the Information Technology Act, 2000, and the rules made thereunder.

The Platform is owned and operated by PIACGS ART AND CRAFT (OPC) PRIVATE LIMITED, doing business as IACG – Indian Art & Craft Gallery (“IACG”, “Company”, “We”, “Us”, “Our”).

By accessing or using the IACG website or mobile application (“Platform”), you (“User”, “Artist”, “Buyer”) agree to be bound by these Terms & Conditions, Privacy Policy, and all applicable laws of India.

Nature of Platform (Intermediary Disclosure)

In accordance with the IT Act, 2000 and Intermediary Rules, 2021:

• IACG acts as an intermediary and online marketplace.
• IACG does not:
  • Own the products listed by artists
  • Control pricing decisions made by artists
  • Guarantee quality, legality, or authenticity of products beyond reasonable checks
• Responsibility for listed products rests solely with the respective sellers.

Eligibility & User Representation

• Users must be legally competent to contract under Indian law.
• By registering, you confirm:
  • Information provided is accurate and up to date
  • You will comply with applicable laws, including IP and consumer protection laws
• IACG reserves the right to suspend or terminate accounts for false or misleading information.

Seller Obligations (E-Commerce Rules, 2020)

Artists/sellers agree to:

• Provide accurate product descriptions, pricing, and images
• Disclose all material information affecting purchase decisions
• Ensure goods are lawful, original, and non-infringing
• Honor return, refund, and grievance obligations

Any violation may result in removal of listings or account suspension.

Membership & Fees

• Registration on IACG is free of charge.
• IACG charges a service fee on completed sales based on badge categories displayed on the Platform.
• Fee structures may be revised with prior notice.

Orders, Payments & Returns

• All sales are subject to a 7-day return policy, as per Platform policy.
• Payments to sellers are settled after the return window closes.
• IACG may withhold payments in cases of:
  • Returns or disputes
  • Policy violations
  • Fraud or suspicious activity

Prohibited Content & Conduct

(As per IT Intermediary Rules, 2021)

Users shall not upload or publish content that:

• Is unlawful, misleading, defamatory, obscene, or abusive
• Infringes intellectual property rights
• Violates any applicable Indian law

Upon receiving actual knowledge or lawful notice, IACG shall remove such content within the prescribed timeframes.

Intellectual Property Rights

• Platform trademarks, logos, software, and content belong to IACG.
• Artists retain ownership of their original content.
• By uploading content, artists grant IACG a non-exclusive, royalty-free license for platform operations and marketing.

Marketing & Promotion Rights

Artists authorize IACG to:

• Promote listed products across digital and social channels
• Use content for advertising and brand communication

This authorization remains valid while content is listed on the Platform.

Shipping & Logistics

• Shipping services may be provided directly or via third-party logistics partners.
• IACG shall not be liable for delays caused by logistics providers, natural disasters, or force majeure events.

Consumer Protection & Transparency

In compliance with Consumer Protection (E-Commerce) Rules, 2020, IACG ensures:

• Transparent pricing
• Clear seller identification
• Fair grievance redressal mechanisms
• No unfair trade practices or price manipulation

Limitation of Liability

• IACG shall not be liable for indirect, incidental, or consequential damages.
• Total liability, if any, shall not exceed the service fees collected for the disputed transaction.
• Use of the Platform is at the user’s own risk.

Indemnity

Users agree to indemnify and hold harmless IACG from any claims, losses, or damages arising from:

• Breach of these Terms
• Violation of laws or third-party rights
• Misuse of the Platform

Termination & Suspension

• Users may terminate their account at any time.
• IACG may suspend or terminate access without notice for:
  • Policy violations
  • Legal or regulatory requirements
  • Fraudulent or harmful activity

Privacy & Data Protection

• Personal data is collected and processed in accordance with the IT Act, 2000 and applicable data protection laws.
• Please refer to our Privacy Policy for detailed information.

Grievance Redressal Mechanism

(As per IT Rules, 2021 & E-Commerce Rules, 2020)

Grievances will be acknowledged within 24 hours and resolved within 15 days.

Modifications

• IACG reserves the right to amend these Terms at any time.
• Continued use of the Platform signifies acceptance of updated Terms.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India, and courts located in India shall have exclusive jurisdiction.
